General Test

This is a legal and binding agreement between you, the user (referred to as “User” or “You”) of the Programs, provided by Us through the Website or any other mode, whether online or offline, and Pickl (referred to as “We”, “Us” , “Our” or “Pickl”). This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.

Registration Data shall mean any data asked by Pickl and submitted by You including but not limited to the name and address of the individual or the company represented by any individual, type of business, general information about the company, or the individual and any identification number. Pickl offers curated and specially designed online higher education and industry-relevant certification programs and career assistance services (“Programs” or “Program”)

The domain name www.pickl.ai (hereinafter referred to as "Website") is owned by TransOrg Solutions and Services Pvt. Ltd., a company incorporated under the Companies Act, 1956 with its registered office at D-100 South City-1 Gurgaon - 122001, Haryana India (hereinafter referred to as "TransOrg Analytics").

The use of the Website and services are governed by the following Terms and Conditions as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If You transact on the Website, You shall be subject to the policies that are applicable to the Website for such transaction. By mere use of the Website, You shall be contracting with Pickl and these Terms and Conditions including the policies constitute Your binding obligations, with Pickl.

When You use any of the services provided by Us through the Website, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms and Conditions and shall be considered as part and parcel of this. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms and Conditions, at any time without any prior written notice. It is Your responsibility to review these Terms and Conditions periodically for updates / changes. Your continued use of the Website following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms and Conditions, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website and the services provided by the Website.

These Terms and Conditions shall apply to Pickl hosted Linked groups, WhatsApp groups, Facebook groups, Instagram pages, Facebook pages, email/SMS/phone communications and other social media forums hosted by Pickl, which shall be deemed to be part of the Website. You acknowledge that certain parts of the Pickl hosted forums, as mentioned above, are provided by third-party service providers, and you agree to abide by their Terms and Conditions. Pickl shall not be responsible for any disruption of services caused by such third-party service providers.

Communications

When You use the Website or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.

Indemnification

You indemnify Pickl and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of your actions on the Website arising out of (a) your use or attempted use of the Website or Programs available on the Website in violation of the Terms; (b) your violation of any law or rights of any third party; or (c) information or Content that you or others post or otherwise make available on the Website or through any Program, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights. You specifically waive any claims that you may have in this behalf under any applicable law.

User Conduct Policy

Whether you have enrolled in a Program or are simply browsing the Website, once you have accessed the Website or Programs, you shall be considered a ‘User’ for the purpose of these Terms and Conditions. You are responsible for all your activities in connection with the use of the Website and Programs. You hereby agree to fully comply with all applicable local, provincial, state, national and foreign laws, treaties and regulations in connection with such use. You shall not resort to any unethical practices while using the Website.

Without limitation, you will not post or transmit, or cause to be posted or transmitted, any communication or solicitation or other "phishing", "pharming" or "whaling" message designed or intended to obtain password, account, personal information, confidential information or private information from any other user of the Website or any other third party whatsoever. However, if any such event does take place, Pickl shall not be liable for any loss of data or if the user’s device, computer or any other property is compromised in any manner.

You acknowledge and agree that Pickl has the right to report any and all suspicious or illegal activity to the appropriate legal or police authorities without notice to you.

During your use of the Website and Programs, you will:

  • not harass other users, students, attendees, support agents or visitors;
  • not create an atmosphere of disharmony, hostility within student groups;
  • notify the instructors, faculty team and or administrative team immediately if you become aware of any other user cheating or breaching these Terms and comply with the requirements of the specific applicable code of conduct, if any, relating directly to a Program into which such user is enrolled.

User Account and Registration Obligations

If You use the Website, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password.

Any access and enrolments to our Programs through registrations is non-transferable. You agree that you will never divulge or share access to your User Account with any third party for any reason. You also agree that you will create, use and/or access only one User Account, and that you will not use any User Account other than your own.

Upon payment of the Program fees – in part or whole, depending on the Program – Pickl shall deliver the Terms and Conditions of the Program and grant you access to the Program. The invoice may be provided to you along with the email confirmation. This shall be a proof of delivery against the successful payment of fees.

Owing to certain exceptional circumstances, if Pickl has granted you access to a Program pending payment, and We do not receive payments within the stipulated time periods, Pickl may, at its own discretion, withdraw your access to the Program without giving any prior notice.

In setting up your User Account, you may be prompted or required to enter additional information, including but not limited to your name and email address. Additional information may be required to confirm your identity. You understand and agree that all information provided by you is accurate, current and complete and that you will maintain and update your information to keep it accurate, current and complete. You acknowledge that if any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your use of the Website and your enrolment into a Program, to the extent applicable.

In addition to the registration process, as part of your use of the Website or participation in the Programs, we may obtain certain information about you and your performance in the Programs. Some of this information may be Personally Identifiable Information. We may use, maintain and store this information to provide certain services to you now and in the future.

Access to the Programs is restricted to attendees or students who have specifically been granted access by Pickl. By registering your User Account, you agree that you will abide by these Terms and any terms specific to the Program.

If you are not able to access the Programs after the complete payment, you should contact your relationship manager or the point of contact person that you may have with us.

Payment Terms

To make payment for any Program offered by Pickl through the Website, you must have internet access and a current valid accepted payment method as indicated during sign-up ("Payment Method"). We do not store any of your credit card information or such other information restricted by the Reserve Bank of India (RBI) for processing payment and has partnered with payment gateways for the payment towards the Programs. By using a third-party payment provider, you agree to abide by the terms of such a payment provider. You agree that in case Pickl’s third-party payment provider stores any such information, Pickl will not be responsible for such storage, and it will be solely at your discretion to allow the third party to store such information. Any loss of such information or any loss incurred by you due to the usage of such information will be solely a loss incurred by you, and We are in no way liable for any such losses and is neither responsible to reimburse / make good such losses in any manner whatsoever.

Failure to pay the applicable Program fee may result in withdrawal of your access to a Program. Depending on where you transact with us, the type of payment method used and where your payment was issued, your transaction with us may be subject to foreign exchange fees or exchange rates. We do not support all payment methods and currencies for payment. All applicable taxes are calculated based on the billing information you provide to us at the time of enrolment/purchase.

If you begin your enrolment with a free Program available on Pickl, You may be ineligible for certain features of a Program as mentioned on the Website.

Programs Usage

Pickl reserves the right to cancel, modify or reschedule any Program or live lectures/webinars, or to alter, modify or rearrange the schedule of topics, as well as the point value or weight of assignments, tests, quizzes, exams, projects and other such evaluations of progress. You also understand that Pickl may modify or discontinue all services related to its Programs at its sole discretion. You agree that We shall not be liable to you or to any third party for any such modification, suspension or discontinuance. Nothing in these Terms and Conditions shall be construed to obligate Us to maintain and support the Programs or any part or portion thereof or any associated services.

You agree that Pickl shall be under no liability whatsoever to you in the event of non-availability of the Website or any portion thereof occasioned by Act of God, war, disease, revolution, epidemic, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of any public utility, man-made disaster or any other cause whatsoever beyond the control of Pickl.

You shall be exclusively responsible for obtaining and maintaining any equipment or ancillary services needed to connect to, access, receive or use the Website, including, without limitation, hardware devices, software, and other internet, wireless, broadband, phone or other mobile communication device connection services. You shall be exclusively responsible for ensuring that such equipment or ancillary services are compatible with the Website, and you shall be responsible for all charges incurred in connection with the use of the Website and Program in connection with all such equipment and ancillary services.

Accreditations and Certifications

Pickl is NOT a University, but an education service provider, offering curated Programs and Programs in association with Indian/International universities, educational institutions etc. (each an “Educational Partner”). Pickl may offer a credential or other acknowledgement for participants who have satisfactorily demonstrated mastery of the Program material. The decision to award any such credential acknowledgement to a given participant will be solely at the discretion of Pickl. Pickl may decide at its sole discretion whether to provide a record concerning a participant’s performance in a Program. The format of any credential or other acknowledgement, and of any performance, provided by Pickl relating to Programs will be determined by Pickl at its sole discretion and may vary from Program to Program.

You will be awarded a certificate of successful completion of a Program (“Program Certificate”) only upon fulfilling the criteria and requirements of Pickl and its Educational Partners where the Program is provided in association. You acknowledge that any such Program Certificate awarded may or may not be affiliated to any Educational Partner and may not stand in the place of a course taken with an Educational Partner or convey academic credit or certification for any Educational Partner.

If you are taking a Program for academic credit or certification as a student of, or otherwise through, an Educational Partner, any such credit or certification may only be awarded directly by the Educational Partner based on its own policies and procedures, and you may be required by that Educational Partner to be registered or enrolled with the Educational Partner in order to receive credit or certification; and, in any event, Pickl will not have any authority or responsibility with respect to any award of academic credit or certification provided by an Educational Partner for a Program.

You acknowledge and agree that any Program offered in association with an Educational Partner may be subject to the terms, policies and procedures of the applicable Educational Partner in addition to Pickl’s Terms and Conditions. Without limiting the foregoing, if you are a student registered or enrolled at, or are otherwise attending, an Educational Partner and are taking a Program for credit or certification through that Educational Partner, you acknowledge and agree that (a) the Educational Partner may have its own terms, policies or procedures regarding your eligibility to participate in the Program, your participation in the Program, the requirements or prerequisites for receiving credit or certification for the Program, and/or your educational or student records as they may relate to your participation and performance in the Program, and (b) your educational or student records are maintained by the Educational Partner, including for purposes of assigning credit or certification, and not Pickl.

Intellectual Property Rights

“Content” means any and all information and data, which may include but not be limited to text, software, scripts, graphics, maps, photos, sounds, music, videos, logos, offers, advertisements, interactive features and other materials.

The Website, Programs and related services are owned and operated by Pickl. All Content or other material available on the Website or through the Programs, including but not limited to online/live lectures, speeches, video lessons, quizzes, presentation materials, assignments, programming assignments, programs, code, and other images, text, layouts, arrangements, displays, illustrations, documents, materials, audio and video clips, HTML and files (collectively “Pickl Content”), are the property of Pickl, and are protected by copyright, patent and/or other proprietary intellectual property rights under Indian and foreign laws.

Pickl logos, trademarks and service marks that may appear on the Website and in the Program are the property of Pickl and are protected under Indian and foreign laws. In addition, elements of the Website are protected by trade dress and other Indian and international intellectual property laws and may not be copied, reproduced, downloaded or distributed in any way in whole or in part without the express written consent of Pickl.

As a condition of accessing the Website and/or using the Programs, you agree not to (a) reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose any Pickl Content or any portion of it thereof, other than as expressly allowed under these Terms and Conditions; and (b) use the Pickl Marks or the name, trademarks, service marks, or other materials of any Educational Partner in connection with, or to transmit, any unsolicited communications or emails or for any other unauthorised purpose.

Please verify all Content prior to use. In the event you come across any Content that is incorrect, infringing, offensive, indecent or objectionable, please notify us immediately at the address mentioned in the Contact Us page.

Termination of Rights

You agree that Pickl, in its sole discretion, may deactivate your account or otherwise terminate your use of the Website or enrolment to a Program with or without reason, including, without limitation, if Pickl believes that you have (a) breached the Terms and Conditions; (b) infringed the intellectual property rights of a third party; (c) posted, uploaded or transmitted unauthorised Content on the Website; or (d) violated or acted inconsistently with the letter or spirit of these Terms and Conditions or any other applicable code of conduct. You agree that any deactivation or termination of your access to the Website or Programs may be effected without prior notice to you and that Pickl shall not be liable to you nor any third party for any termination of your account or enrolment into a Program. You also acknowledge that Pickl may retain and store your information on Pickl’s systems notwithstanding any termination of your account or enrolment into the Programs.

General Website Usage Terms

You agree, undertake and confirm that Your use of Website shall be strictly governed by the following binding principles:

1)   You shall not display, upload, publish, transmit, update or share any information which:

  • belongs to another person and to which You does not have any right to;

  • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  • contains video, photographs, or images of another person (with a minor or an adult).

  • shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider ("ISPs") or other suppliers;

3)   You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable domestic laws, rules and regulations. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force.

4)   You shall not engage in advertising to, or solicitation of, other Users of the Website to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the Website or related to us. You may not transmit any chain letters or unsolicited commercial or junk email to other Users via the Website. It shall be a violation of these Terms of Use to use any information obtained from the Website in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to another person other than Us without Our prior explicit consent. Arbitration

Any dispute or claim arising out of this Agreement shall be settled amicably and failing to which, the dispute shall be referred for arbitration according to the Arbitration and Conciliation Act 1996. There shall be three arbitrators, each party appoints one arbitrator and the third arbitrator is appointed by the two appointed arbitrator. The seat of arbitration shall be Gurgaon, Haryana.

The following terms and requirements (the “Terms”) apply to the Pickl.AI Job Guarantee Program - Money Back Policy.

Terms and Conditions for Eligibility of Job Guarantee Program

Pickl.AI assumes the liability to give a 100% Job Guarantee or the aggregate sum to be discounted liable to terms and conditions relevant here under:

  • Participants should be graduates
  • You must be proficient in spoken and written English, as determined by initial interactions with our counselling team.
  • Able to show valid mark sheets & certificates with a minimum of 60% academic record throughout.
  • Should have a valid PAN Card and Aadhaar Card.
  • Must be able to pass a background check from your previous employers/institutes (if applicable).
  • The 6-month guarantee period (the “search period”) starts when you are approved for completion after completing the mandatory requirements of course completion and capstone project completion.

Terms and Conditions during the course of Job Guarantee Program

  • Participants should have an attendance of 100% in live sessions.
  • Each candidate has to work on projects to build a strong portfolio.
  • The total Fee needs to be cleared.
  • Should get a minimum of 80% in the test or assessments.
  • Assignments & Projects should be submitted within the given time as per the schedule.
  • Should have cleared both the certifications of course completion & capstone project within the allocated schedule.

Refund Policy

Without limiting the preceding, situations that void this guarantee include, but are not limited to:

  • You turn down a proposition for employment for a qualifying position
  • You choose not to continue the employment route with Pickl.AI
  • You acknowledge a job that doesn’t meet the qualifying position standards and is outside of the Data Science/Analytics field/industry before the Job Guarantee Period is finished
  • You don’t invest adequate and reliable energy during the Job Guarantee Program into your pursuit of employment, as illustrated previously
  • You don’t speak with the situation group reliably all through your inquiry, including informing us of any offers you have gotten
  • You don’t go after reasonable positions (as suggested by Pickl.AI team) for your experience, or you do not apply for jobs referred to you
  • You left the course in the middle, or you have taken a break from the course and re-went along with it
  • There has been one or more instances wherein you didn’t pay your fee instalments within the due date
  • You do not follow through interview/qualifying process in a timely and professional manner.
  • You are unable to complete the program within the specified duration (as per the schedule shared) of the program
  • You do not attend the career preparation sessions arranged for you at the agreed date and time
  • You turn down a job offer with a proposal, or if you disagree with relocating as per the employer’s requirement and turn down the offer
  • You take up another position outside on your own
  • You failed to pass the background check associated with the job offer
  • You do not get a job offer of more than INR 5,00,000/- during the Gurantee Period.

Procedure for Reimbursement

You are required to certify that you have met all the Terms of this Job Guarantee Program and have not been offered any job opportunities, and your Job Guarantee Program does not stand void due to any of the circumstances mentioned above in the Refund Policy.

After you have complied with all the Terms and Conditions applicable thereof and have not received an offer for a position within the Guarantee Period (6 months after the completion of the capstone project as per the schedule given), you may request a refund of your Tuition Fee. The request form must be submitted within 10 days post the end of the Guarantee Period*.

General

Pickl.AI’s Job Guarantee Program - Money Back Policy and Terms set forth the entire understanding between you and Pickl.AI with regard to the subject matter herein. Any unenforceable provision of these Terms shall not impact the enforceability of any other provision. Pickl.AI shall have the sole discretion to determine whether the Terms have been satisfied and whether you are eligible for a refund of your tuition.

These Terms and Conditions may be modified at any time, and we will let you know if we update anything.
